Koenig Machinery Pty Ltd Supplier’s Warranty
Koenig Machinery Pty Ltd provides the following Warranty subject to the terms and conditions set out below.
The benefits provided to the Customer in this Warranty are provided in addition to the Customers rights under Competition and Consumer Act 2010 (Cth) and similar laws of the States and Territories of the Commonwealth of Australia. (“Consumer Laws”)
1. Definitions and Interpretation
In this Warranty, unless contrary to or inconsistent with the context:
1.1 – “Koenig” or “Our” means Koenig Machinery Pty Ltd (ACN 167 018 117), of 55 Metrolink Court, Campbellfield VIC 3061, who is the importer and supplier of the Laser Machines.
1.2 – “Customer” or “You” means the party who acquires a Laser Machine from Koenig.
1.3 – “CO2 Laser Range” means the Laser Machines using a gas-state carbon dioxide laser emitting a 10.60 nanometre beam derived being KOENIG K0604c, KOENIG K0906c, KOENIG K1309c, KOENIG 1325M-280W, KOENIGK1325 and KM1309FC KM1313FC, supplied by Koenig and manufactured by G-Weike.
1.4 – “Consumable Component” means the parts and components of the Laser Machines listed in Schedule 2 and supplied by Koenig, that will require periodic replacement within the time frame specified in Schedule 2 in the course of the normal use of the Laser Machine.
1.5 – “Expected Lifetime” means time frame specified in Schedule 2 within which the periodic replacement of a Consumable Component will be required in the course of the normal use of the Laser Machine.
1.6 – “Fiber Laser Range” means the Laser Machines that uses active optical Fibers to create a laser beam and a transport fiber light energy to the machine’s cutting head being LF1309, LF1313, KM1309FC, LF1313FC ,LF3015P Pro, LF3015GA, LF3015GA Pro LF3015GAR, LF3015GCR, LF3015CNR, LF60M, LF60MA, LF60MS Fiber metal tube and sheet cutting machine Fully enclosed Fiber tube/sheet cutting supplied by Koenig and manufactured by G-Weike.
1.7 – “Fiber Laser Designated Parts” means the rack and pinion drive system, motors, motor drivers and drive rails used in the Fiber Laser Range of Laser Machines.
1.8 – “Fiber Marking Range” means the fiber marking machines being KOENIG K20FMC, KOENIG K20FMO and KOENIG COLOUR supplied by Koenig and manufactured by G-Weike.
1.9 – “Laser Machine” means the machines and parts and components thereof that comprise the CO2 Laser Range, the Fiber Laser Range and Fiber Marking Range supplied by Koenig, including the Laser Source and Laser Fiber Designated Parts but excluding the Consumable Components.
1.10 –“Laser Machine Part” means any part or component of a Laser Machine excluding the Consumable Components.
1.11 –“Laser Source” means the laser power sources used in the Laser Machines that produce the laser energy before its converted into the light energy.
1.12 – Words denoting the singular include the plural and vice versa.
2. Warranties
Product Warranty
2.1 – The Product Warranty is provided subject to the Exclusions set out in Clause 4.
2.2 – Koenig warrants that each Laser Machine will be free from material and workmanship defects under normal use, maintenance and service for the Product Warranty Period specified in the table below from the date of delivery of the Laser Machine to the Customer. (“Product Warranty”)

2.3 – For the Customer to be entitled to the benefit of the Product Warranty, the Customer must, upon becoming aware of any defect during the Product Warranty Period:
(a) cease using the Laser Machine immediately; and
(b) make a Product Warranty Claim in accordance with the warranty claim procedure set out in clause 3 within seven (7) days of the date that the defect was discovered by the Customer.
2.4 – If Koenig accepts the Product Warranty claim, Koenig will:
(a) At Koenig’s election:
- Repair the defective Laser Machine or Laser Machine Part(s); or
- Replace the defective Laser Machine or Laser Machine Part(s) with either new or refurbished part(s). The parts of the Laser Machine required to comply with this warranty shall be supplied by Koenig.
(b) Cover the costs of repairing or replacing the defective Laser Machine or Laser Machine Part(s).
Consumable Component Warranty
2.5 – The Consumable Component Warranty is provided subject to the Exclusions set out in Clause 4.
2.6 – The Consumable Components (listed in Schedule 2) have an Expected Lifetime and will require periodic replacement under normal use of the Laser Machines. The costs of periodic replacement of the Consumable Components will be covered by the Customer.
2.7 – Koenig warrants that each Consumable Component supplied by Koenig will be free from material and workmanship defects under normal use, maintenance and service for the Expected Lifetime. (“Consumable Component Warranty”)
2.8 – For the Customer to be entitled to the benefit of the Consumable Component Warranty, the Customer must, upon becoming aware of any defect in the Consumable Component during the Expected Lifetime specified in Schedule 2:
(a) cease using the Laser Machine immediately; and
(b) make a Consumable Component Warranty Claim in accordance with the warranty claim procedure set out in clause 3 within seven (7) days of the date that the defect was discovered by the Customer.
2.9 – If Koenig accepts the Consumable Component Warranty Claim, Koenig will:
(a) At Koenig’s election, replace the defective Consumable Component with either a new, repaired or refurbished Consumable Component.
(b) Cover the costs of repairing or replacing the defective Consumable Component other than costs associated with installation.
Service Warranty
2.10 – The Service Warranty is provided subject to the Exclusions set out in Clause 4.
2.11 – Koenig will provide and cover the costs of any required servicing or maintenance of the Laser Machine for one (1) year from the date of delivery of the Laser Machine in the case of any problem with the Laser Machine that:
(a) cannot be resolved by basic maintenance procedures set out in the user manual for the Laser Machine or by re-calibration of the Laser Machine;
(b) is not a focus alignment issue or calibration of power setting for materials
(c) is not the periodic replacement of a Consumable Component;
(d) is not a problem or defect that is excluded under Clause 4. (“Service Warranty”)
2.12 – For the Customer to be entitled to the benefit of the Service Warranty, the Customer must, upon becoming aware of a problem with the Laser Machine, make a Service Warranty Claim in accordance with the warranty claim procedure set out in clause 3 within seven (7) days of becoming aware of the problem.
3. Warranty Claim Procedure
Warranty Claim Form
3.1 – To make a warranty claim under this warranty, the Customer must:
(a) Complete the Warranty Claim Form set out in Schedule 1; click here to download
(b) Specify in the Warranty Claim Form whether the Customer is making a Claim under:
- The Product Warranty (“Product Warranty Claim”)
- The Consumable Component Warranty (“Consumable Component Warranty Claim”) or
- The Service Warranty (“Service Warranty Claim”)
(c) Send the completed Warranty Claim Form and any supporting documents, evidencing the claimed defect or problem with the Laser Machine, Laser Machine Part or Consumable Component, to Koenig. (Koenig’s contact details are set out in Schedule 1) (“Warranty Claim”)
Warranty Claim Investigation
3.2 – Following receipt of a completed Warranty Claim Form and supporting documentation evidencing the defect or problem with the Laser Machine, Laser Machine Part or Consumable Component, Koenig will contact the Customer by telephone and/or email to:
(a) investigate the Warranty Claim;
(b) try to resolve any issues with the Laser Machine, including by providing instructions to the Customer by telephone;
(c) advise of any further documents, evidence or information required by Koenig to investigate and assess the Warranty Claim; or
(d) advise of any reasonable further actions Koenig requires the Customer to undertake to assist Koenig to investigate and assess the Warranty Claim.
3.3 – The Customer must cooperate with Koenig’s efforts to investigate and assess the Warranty Claim and/or try to resolve any issues with the Laser Machine, including by:
(a) Providing further information about the Warranty Claim and/or evidence of the defect as reasonably requested by Koenig.
(b) Following any reasonable instructions provided by Koenig in order for Koenig to investigate the Warranty Claim and/or resolve any issues with the Laser Machine.
(c) Making the defective Laser Machine, Laser Machine Part or Consumable Component available to be transported to Koenig or an authorised repairer’s service facility if required for the investigation and assessment of the Warranty Claim.
(d) Accepting delivery of the Laser Machine, Laser Machine Part or Consumable Component from Koenig or an authorised repairer that is being returned to the Customer as part of the Warranty Claim Procedure.
(e) Cooperating with any other reasonable request made by Koenig in order for Koenig to investigate the Warranty Claim and/or try to resolve any issues with the Laser Machine.
3.4 – Upon completing an investigation, Koenig will process and assess the Warranty Claim, and notify the Customer as to:
(a) whether Koenig accepts or rejects the Warranty Claim; and
(b) In the event Koenig accepts the Warranty Claim, the next steps to be undertaken by Koenig and the Customer for the Warranty Claim to be actioned; or
(c) In the event Koenig rejects the Warranty Claim, Koenig’s reasons for rejecting the Warranty Claim.
Accepted Warranty Claims
3.5 – If a Product Warranty Claim or a Consumable Component Claim is accepted by Koenig the Warranty Claim will be processed and actioned in accordance with Koenig’s normal work flow and in accordance with the steps set out below.
Repair
3.6 – If the defective Laser Machine or Laser Machine Part is to be repaired under a Warranty Claim that has been accepted by Koenig, Koenig will:
(a) Notify the Customer when Koenig or an authorised repairer is available to repair the defective Laser Machine or Laser Machine Part.
(b) If it is foreseeable that the repair of the Laser Machine or Laser Machine Part will be delayed by a matter beyond Koenig’s reasonable control, notify the Customer of the delay and the reason for the delay.
(c) Provide instructions to the Customer of any steps required to be undertaken by the Customer in order for the defective Laser Machine or Laser Machine Part to be repaired.
(d) Arrange for Koenig or an authorised repairer to repair the Laser Machine or Laser Machine Part at the Customer’s site, or if required, at Koenig or an Authorised Repairer’s facility;
(e) Cover the costs of the repair, including any labour costs and travel costs of an authorised repairer to attend the Customer’s site to repair the Laser Machine or Laser Machine Part.
Replacement
3.7 – If the defective Laser Machine, Laser Machine Part or Consumable Component is to be replaced under a Warranty Claim accepted by Koenig, Koenig will:
(a) Notify the Customer of the estimated date of delivery of the replacement Laser Machine, Laser Machine Part or Consumable Component.
(b) If it is foreseeable that the replacement of the Laser Machine, Laser Machine Part or Consumable Component will be delayed by a matter beyond Koenig’s reasonable control, notify the Customer of the delay and the reason for the delay.
(c) Arrange for the replacement Laser Machine, Laser Machine Part or Consumable Component to be delivered to the Customer.
(d) Cover the costs of the replacement Laser Machine, Laser Machine Part or Consumable Component, including delivery of the replacement Laser Machine, Laser Machine Part or Consumable Component to the Customer.
3.8 – The Customer Agrees that where a Laser Machine, Laser Machine Part or Consumable Component is replaced by Koenig under a Warranty Claim, the ownership in the defective Laser Machine, Laser Machine Part or Consumable Component will revert to Koenig.
Transportation
3.9 – If the repair or replacement of the defective Laser Machine, Laser Machine Part or Consumable Component under a Warranty Claim accepted by Koenig requires the Laser Machine, Laser Machine Part or Consumable Component to be transported to Koenig or an authorised repairer:
(a) Koenig will arrange for and cover the costs of transportation of the defective Laser Machine, Laser Machine Part or Consumable Component to Koenig or an authorised repairer’s service facility from the Customer’s site.
(b) The Customer must make the defective Laser Machine, Laser Machine Part or Consumable Component available for transportation and provide any such assistance required to transport the defective Laser Machine, Laser Machine Part or Consumable Component.
(c) Koenig will arrange for and cover the costs of delivery of the repaired Laser Machine, Laser Machine Part or a replacement Laser Machine, Laser Machine Part or Consumable Component to the Customer’s site from Koenig or an authorised repairer’s service facility.
(d) The Customer must accept delivery of the repaired Laser Machine or Laser Machine Part or the replacement Laser Machine, Laser Machine Part or Consumable Component.
Installation
3.10 – If the replacement of a Laser Machine or Laser Machine Part under a Warranty Claim accepted by Koenig requires an authorised technician to install the Laser Machine or Laser Machine Part at the Customer’s site:
(a) Koenig will arrange for and cover the costs of an authorised technician to attend the Customer’s site to install the replacement Laser Machine or Laser Machine Part, including any travel costs of the authorised technician.
(b) The Customer must provide Koenig or the authorised technician access to the Customer’s site and any such assistance required to install the replacement Laser Machine or Laser Machine Part.
Servicing and Maintenance
3.11 – If a Service Warranty claim is accepted by Koenig:
(a) Koenig will arrange for and cover the costs of servicing or maintenance of the Laser Machine.
(b) The Customer must make the Laser Machine available for servicing or maintenance and provide any such assistance required.
4. Exclusions
4.1 – The Product Warranty, Consumable Component Warranty and Service Warranty do not cover:
(a) Defects, damage or deterioration of the Laser Machine, Laser Machine Parts or Consumable Components due to normal use, wear, tear, exposure, storage or corrosion.
(b) Installation costs associated with the periodic replacement of Consumable Components;
(c) Recalibration or maintenance that should be performed by the Customer in accordance with the applicable Laser Machine User Manual, including alignment issues or adjusting cut settings for different materials.
(d) Defects or damage caused by failure to maintain or use Laser Machine, Laser Machine Parts or Consumable Components in accordance with the manuals, maintenance schedules, recommended procedures or good practice.
(e) Defects or damage to the Laser Machine, Laser Machine Parts or Consumable Components caused by improper storage, operation or use;
(f) Defects or damage to the Laser Machine, Laser Machine Parts or Consumable Components caused by:
- the use or installation of parts, components or accessories other than those approved by Koenig; or
- unauthorised alterations to the Laser Machine, Laser Machine Parts or Consumable Components.
(g) Defects or damage resulting from alterations or repairs made to the Laser Machine, Laser Machine Parts or Consumable Components in an unauthorised manner or by a technician/repairer not authorised by Koenig;
(h) Defects or damage to the Laser Machine, Laser Machine Parts or Consumable Components caused by electricity failure, power surges, fire or acts of nature, such as lightning, storms or floods.
5 – Third-party manufacturer’s warranty
5.1 – Some Koenig machines such as the Fiber lasers and tube lasers come installed with a Tower computer for running the machine. The computer runs on Microsoft Windows this component of the Koenig machines is covered by a warranty provided by computer manufacturer. The computer itself is only covered by the manufactures own warranty of 12months.
5.2 – Information concerning warranties provided by manufacturers of other components of the Koenig machines can be obtained from Koenig Machinery if Applicable
Important Notice For the supply of Laser Machines to Customers who are consumers in accordance with Section 3 of the Australian Consumer Law – Schedule 2 to the Competition and Consumer Act 2010 (Cth), our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. |
6 – Limitation of liability for failure to comply with Consumer Guarantees
6.1 – Where goods (other than goods of a kind ordinarily acquired for personal, domestic or household use and consumption) supplied by Koenig to the Customer fail to comply with any statutory guarantee conferred by the Competition and Consumer Act 2010 (Cth), Consumer Laws and any other laws applicable, that cannot be lawfully excluded, restricted or modified, Koenig’s liability for failure to comply with any such guarantee (other than a guarantee under section 51, 52 or 53 of Schedule 2 to the Competition and Consumer Act 2010 (Cth) and other Consumer Laws) shall be limited at the option of Koenig to one or more of the following:
(a) the replacement of the goods or supply of equivalent goods;
(b) the repair of the goods;
(c) the payment of the cost of replacing the goods or of acquiring equivalent goods; or
(d) the payment of the costs of having the goods repaired.
6.2 – Where the services (other than services ordinarily acquired for personal, domestic or household use or consumption) supplied by Koenig to the Customer fails to comply with any statutory guarantee conferred by the Competition and Consumer Act 2010 (Cth), Consumer Laws and any other laws applicable, that cannot be lawfully excluded, restricted or modified, Koenig’s liability for failure to comply with any such guarantee shall be limited at the option of the Koenig to one or more of the following:
(a) the supplying of the services again; or
(b) the payment of the costs of having the services supplied again.
7 – Limitation of Liability other than for failure to comply with Consumer Guarantees
7.1 – Subject to clauses 6.1 and 6.2, nothing in this warranty excludes, restricts or modifies any:
(a) Rights of the Customer conferred by the Consumer Laws;
(b) Any liability of Koenig for a failure to comply with a consumer statutory guarantee conferred by the Competition and Consumer Act 2010 (Cth), Consumer Laws and any other laws applicable that cannot be lawfully excluded.
7.2 – Subject to any rights of the Customer at law, including to the Consumer Laws, which cannot be excluded, limited, restricted or modified and to the extent permitted by law, Koenig’s liability to the Customer in respect of any loss or damage, including loss of income, loss of profits, loss of contracts or any other indirect or consequential loss or damage arising directly or indirectly from:
(a) Supply of the Laser Machines, Laser Machine Part or Consumable Components and supply of services by Koenig or its authorised repairer to the Customer.
(b) The use or interruption to the use of the Laser Machines, Laser Machine Parts or Consumable Components.
(c) Any defective Laser Machine, Laser Machine Parts or Consumable Components;
(d) Any breach of contract or breach of warranty;
(e) Any tortious or wrongful act or omission, including negligence, on the part of Koenig shall by limited to the amount payable by the Customer to Koenig for the supply of the Laser Machine, Laser Machine Parts or Component Consumables.
7.3 – Nothing in this warranty excludes, limits, restricts or modifies Koenig’s liability for death or personal injury or for any other liability that cannot be excluded, limited, restricted or modified at law.
